What does it mean?
The Corporate Sustainability Reporting Directive (CSRD) introduces a detailed sustainability reporting obligation for large companies from 2024 onwards. The mere claim to be "CSRD-compliant" without concrete information on the preparation of the report (e.g. applied ESRS standards, auditor, availability of the report) constitutes a lack of substantiation and can be assessed as withheld information under § 5b UWG. The increased transparency through CSRD reporting also creates a basis for examining sustainability claims in marketing, thereby increasing the risk of cease-and-desist letters if advertising claims cannot be substantiated by the CSRD report.
