What does it mean?
The EU Taxonomy Regulation (EU) 2020/852 defines environmentally sustainable economic activities and creates a framework for the classification of financial products. In particular, Articles 8 and 9 of the Sustainable Finance Disclosure Regulation (SFDR, Regulation (EU) 2019/2088) require funds to disclose the proportion of EU Taxonomy-compliant investments. Without this specific information, the claim "EU Taxonomy-compliant" or "green fund" is misleading under § 5 UWG, as it does not provide verifiable information and thus violates the stricter rules of the EmpCo Directive (EU 2024/825). A lack of substantiation constitutes withheld information pursuant to § 5b UWG.
