What does it mean?
Self-created labels such as 'Klimacheck' without independent certification are to be classified as misleading and thus prohibited from 27 September 2026 under the EmpCo Directive (EU 2024/825). Annex I No. 4a UCPD defines this as a per se prohibition, as such self-created labels can deceive consumers about the actual environmental performance. Under Section 5 UWG and the EmpCo Directive (EU 2024/825), consumers expect production within a 50-kilometre radius for regional claims. By analogy: a self-appointed label creates an expectation that cannot be fulfilled without independent verification. To advertise in a legally compliant manner, the use of recognised certificates with a clear licence number is essential.
