„Right to Repair"

What does it mean?
The Ecodesign Regulation (EU) 2024/1781, in force since 23 October 2024, implements the 'Right to Repair' and obliges manufacturers to make available spare parts and repair instructions for certain product groups (e.g. washing machines, refrigerators, televisions) for a period of 7 to 10 years. The claim 'repairable' without specific information on the availability of spare parts and repair instructions is misleading under § 5 UWG and requires substantiation. Anyone advertising the right to repair must transparently explain how they fulfil the requirements of the Regulation. The French 'Indice de Réparabilité' serves as an example of possible labelling, but is not mandatory.
