What is the EmpCo Directive and when does it take effect?
EU 2024/825 — the "Empowering Consumers Directive" — prohibits blanket environmental claims without specific evidence across the entire EU from 27 September 2026. In Germany it is implemented through the UWG.
Who can issue a warning notice against me?
Competitors, qualified trade associations (IHK, Wettbewerbszentrale) and consumer-protection associations. A warning notice (Abmahnung) typically costs 1,000–5,000 € — a preliminary injunction considerably more.
How high are the fines really?
The EmpCo Directive provides for the fine ceiling of up to a maximum of 4 % of annual turnover in the affected EU member state only in EU-wide coordinated CPC enforcement (Art. 21 Reg. 2017/2394, § 19 UWG); the regular consequence in an individual case is a warning notice/cease-and-desist/damages. For a mid-sized company with 10 million € in turnover, the statutory maximum would arithmetically be 400,000 € — but the actual fine depends on the severity of the infringement, intent/negligence and repetition, and is determined case by case by the respective supervisory authority. In current UWG practice, sanctions for SMEs are typically well below that; more reliably calculable are the legal costs of warning notices (regularly in the four- to five-figure range).
Is it enough to simply remove "climate-neutral"?
Often not. Generic terms such as "sustainable", "green", "environmentally friendly" are affected too. In addition, meta tags, alt texts and PDFs must be checked — which is exactly what this tool exists for.
How does Empcora differ from a law firm?
